Terms of Service

These Terms of Service ("Terms") govern your access to and use of Zawiya ("we," "us," or "our") — a professional photo gallery delivery platform. By creating an account or using Zawiya, you agree to these Terms. Please read them carefully.

1. The Service

Zawiya provides software tools that allow professional photographers ("Photographers") to upload, organise, and share photo galleries with their clients ("Clients"). Zawiya also operates a marketplace allowing Clients to purchase gallery upgrades directly from within a gallery.

2. Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@zawiya.app if you suspect unauthorised access.

You may not share your account with others, create multiple accounts for the same business, or impersonate any person or entity.

3. Acceptable Use

You agree not to:

• Upload content that is illegal, harmful, defamatory, or infringes third-party intellectual property rights.
• Use Zawiya to distribute malware, spam, or unsolicited communications.
• Attempt to gain unauthorised access to other users' accounts or galleries.
• Reverse engineer, scrape, or otherwise extract data from the platform in bulk.
• Resell or sublicense access to the platform without our written permission.

4. Content & Intellectual Property

Your content. All photographs and creative content you upload remain your sole intellectual property. By uploading content, you grant Zawiya a limited, non-exclusive licence to store, display, and deliver that content solely for the purpose of operating the service.

Our platform. All software, design, trademarks, and branding associated with Zawiya are owned by us. You may not copy, modify, or redistribute them without our written consent.

5. Plans, Billing & Payments

Zawiya offers free and paid subscription plans. Paid plans are billed monthly or annually via our payment processor, Paddle. By subscribing, you authorise Paddle to charge your payment method on a recurring basis.

Prices are displayed in USD. You are responsible for any applicable taxes in your jurisdiction. Paddle acts as the Merchant of Record for all transactions and handles VAT and sales tax compliance globally.

We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing cycle.

6. Marketplace Purchases

Clients may purchase one-time gallery upgrades (such as watermark removal, original quality downloads, or ZIP exports) through the Zawiya Marketplace. These are non-subscription payments processed by Paddle. Zawiya retains a 20% commission; 80% is passed to the Photographer. Please see our Refund Policy for information on refunds.

7. Gallery Lifecycle & Storage

Galleries are subject to expiry periods that depend on your subscription plan. Expired galleries enter a recovery window before being permanently deleted. Zawiya does not guarantee indefinite storage and is not responsible for data loss due to expiry, account closure, or service interruptions.

8. Termination

You may cancel your account at any time from your dashboard. We may suspend or terminate your account if you violate these Terms, with or without prior notice. Upon termination, your galleries and data will be scheduled for deletion in accordance with our data retention policy.

9. Disclaimer of Warranties

Zawiya is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation. Use the service at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, Zawiya's total liability for any claim arising out of or related to these Terms or the service shall not exceed the amount you paid us in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

11. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through binding arbitration or the courts of competent jurisdiction, depending on your location.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice at least 14 days before taking effect. Continued use of the service after changes constitutes acceptance.
